Service Agreement
Effective: June 2025


Thank you for booking with Prestige – On Demand. (“Contractor,” “We,” “Us,” or “Our”). Please review this Service Agreement carefully. By booking or using our services, you (“Client” or “You”) agree to the following terms and conditions, which together form a legally binding agreement.

Modifications and Scheduling
Prestige – On Demand reserves the right to modify, cancel, or reschedule appointments due to staffing availability, traffic delays, weather conditions, or equipment issues. 

Service Times & Unexpected Delays
Our service providers may arrive up to 120 minutes after the scheduled appointment window due to unforeseen circumstances such as traffic, scheduling delays, or acts of nature. If this occurs, we commit to notify you via your preferred method of communication regarding any delays or cancellations.

Service Access & Quality
By booking our services, you agree to provide us with safe, unrestricted access to the location or area requiring service. This includes physical access, required utilities (e.g., water, electricity), and a hazard-free environment.

Prestige aims to deliver all services to a professional, high-quality standard. Any concerns about service quality must be reported within 24 hours of completion. We are not responsible for concerns raised after this period or if you are not available for a final walk-through.

Limitations of Liability & Pre-existing Conditions
While we may document pre-existing conditions failure to disclose or withold prexisting issues withdraws our ability to , Prestige is not responsible for any existing damage prior or not disclosed in prior to the start of service. 

We do not guarantee results, and no warranties are expressed or implied. Our total liability for any claim is limited to the amount paid for the service in question. We are not liable for indirect, incidental, special, or consequential damages under any circumstances.

Service Terms, Payment & Fees
The “Total Cost” is displayed at the time of booking.

If service takes 20% longer than estimated, an additional $75 per extra 30 minutes may be charged, with your approval.

All services must be prepaid via credit card, debit, or cash.

Late payments incur a 12% late fee plus 3% daily interest until paid in full.

You are responsible for any collection costs, legal fees, or administrative expenses related to unpaid balances.

Processing, Travel, and Distance Fees
Prestige – On Demand may apply additional fees, including:
Payment Processing Fees for third-party platform or card transactions. Travel Time/Lodging  Fees for locations may be requiring for extended travel locations Distance-Based Fees for appointments outside our standard service radius apply. Any applicable fees will be disclosed at the time of booking or before confirmation.

Access Requirements
Clients must ensure that the service location is safe, legal, and accessible, and provide any required water or electrical hookups if applicable.

Failure to meet access requirements will result in a $350 cancellation fee.

Force Majeure
We are not liable for any delay or failure to perform services caused by events outside of our control, including but not limited to: natural disasters, fires, power outages, epidemics, civil unrest, strikes, governmental orders, or transportation failures.

Safety
You must disclose any hazardous materials or unsafe conditions in the service area prior to the appointment. You assume full responsibility for any health or safety risks associated with your property or environment.

32 hours in advance: $0 cancellation fee
Less than 24 hours: $180 cancellation fee

No Call / No Show or Access not provided: 
Full service amount charged, up to $350

Final Quality Check
You are expected to be present for a final inspection and quality check. 

Refunds & Chargebacks
All sales are final.

Refunds Policy 
Prestige will only issue a refund if a) the service was not rendered (b) or you are outside of our coverage area.

If you initiate a chargeback, we will provide your bank with all related documentation, including service logs, communications, time stamps, and any photos/videos of work performed.

Submitting false chargebacks is considered breach of contract and will result in permanent account deactivation and possible legal action.

Governing Law & Venue
This agreement is governed by and construed in accordance with the laws of the State of Florida.
All disputes must be brought exclusively in the state or federal courts located in Melbourne, Florida, unless otherwise stated in the arbitration clause below.

Arbitration Clause
Any dispute, claim, or controversy arising out of or relating to this Agreement or the services provided shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Melbourne, Florida. Each party shall bear its own costs.

The arbitrator’s decision will be final and binding and may be entered in any court of competent jurisdiction. Class action waivers apply: disputes must be brought on an individual basis only. Consolidated or representative actions are not permitted. If a court finds the class action waiver unenforceable, then the arbitration clause shall be void and the matter will proceed in court.

Indemnification
You agree to indemnify, defend, and hold harmless Prestige – On Demand, its owners, contractors, and affiliates from any and all claims, losses, or damages arising from:

Your failure to disclose relevant conditions or hazards;

Your lack of authority to book the service;

Any violations of this agreement.

Photography & Marketing
Unless you opt out in writing, you grant us permission to use photos, videos, or digital media taken during service for marketing and promotional purposes, we may even utilize your brand in publications .

Client Acknowledgment
By booking or receiving services, you confirm the following:

You are at least 18 years old and have the legal authority to enter this agreement. You agree to all terms listed in this agreement. You understand that your payment is for dedicated time and effort, not any explicit guaranteed results. You acknowledge that all warranties pertaining to parts, service provided or if applicable, for films, coatings, or treatments, or any implied warranties expressed by manufacturer must be handled directly with the product or manufacturing vendor. You understand that Prestige’s liability is capped to the amount paid for each individual & customer specific job.

Electronic Consent
Is granted to Prestige: By clicking submitting payment, or scheduling a service full step, you acknowledge that you have read, understood, and agreed to be bound by this Service Agreement. You also consent to receive communication, service confirmations, and documentation related only to prestige - on demand electronically.
